Terms of Service

These terms apply when you buy the Beard Growth Audit or connect an account to the Beard Capital Audit app. The services are provided by Simon Beard and Beard Capital ("Beard", "we", "us"). By paying for an audit or connecting an account, you agree to these terms.
The service
The Growth Audit is a review of your business's performance. You connect accounts such as Xero, Shopify, Stripe, Meta Ads and Google Ads. We read the data through each platform's official API and deliver a written audit brief with findings and recommendations.
Price and payment
The Growth Audit costs $5,000 AUD, including GST, unless we agree a different price with you in writing. We will issue a tax invoice. Work starts once payment is received and your accounts are connected.

If you don't feel the audit was worth it, email [email protected] within 14 days of your findings call with Simon and ask for a refund. You'll get the full amount back, and you don't need to give a reason. Simon refunds straight away, to the original payment method. Your bank may take a few business days to show it.
Who can use it
Only connect accounts you own or are authorised to act for. By connecting an account, you confirm you can grant the read-only access requested.
What you authorise
You give us read-only access to the connected accounts to prepare your audit. We never create, change or delete anything in them. We never post, manage campaigns, move money or place orders for you. You can revoke access at any time.
The audit is information, not advice
The audit is provided for information only. It is not financial, investment, legal, tax or accounting advice, and it is not a recommendation to take any particular action. Any decision you make based on it is your own. Figures come from what your connected accounts return when we pull them, and may differ from your own records. We can't promise a particular business result. If the audit wasn't worth it to you, the money-back guarantee above applies.
Your responsibilities
- Keep your platform and login credentials secure.
- Follow each connected platform's own terms and policies.
- Do not try to disrupt, reverse-engineer or gain unauthorised access to our systems.
Confidentiality and data
We keep your business data confidential. We use it only to prepare your audit and in aggregated, anonymised benchmarks covering at least five businesses. We do not sell it. Our Privacy Policy covers how we collect, store, delete and protect it, including our Google API Limited Use commitment, and forms part of these terms.
Your consumer rights
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.
Limitation of liability
To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or goodwill, arising from the audit or your reliance on it. Where liability cannot be excluded but can be limited, our total liability is limited to resupplying the service or refunding the amount you paid for it.
Availability and changes
We provide the app on a best-effort basis and do not guarantee it will run without interruption or errors. We may update these terms. If we do, the date above changes. Changes do not affect an audit you have already paid for.
Ending access
You can disconnect any account at any time in that platform, or by emailing [email protected]. We then delete that connection and its token as described in the Privacy Policy.
Governing law
These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
